Welcome to The Gut Pet. These Terms of Service govern your access to and use of our website, online store and related services.

In these Terms, “we”, “us”, “our” and “The Gut” refer to The Gut Pet Pty Ltd, operating under the registered business name The Gut Pet.

The Gut operates this website and online store, including all related information, content, features, tools, products and services (collectively, the “Services”). The Gut is powered by Shopify, which enables us to provide the Services to you.

By accessing or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these Terms or our Privacy Policy, please do not use or access our Services.

These Terms should be read together with our other policies available on our website, including our Refund, Returns, Exchanges & Shipping Policy and Shipping & Delivery Policy.

Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.


Section 1: Access & Account

By using our Services, you represent that you are at least 18 years of age or otherwise have the legal capacity to enter into these Terms.

To use certain features of the Services, including placing an order, you may be asked to provide information such as your name, email address, billing information, payment information and shipping address.

You agree that the information you provide is accurate, current and complete and that you have the right to provide that information.

If you create an account with us, you are responsible for maintaining the confidentiality of your account credentials and for all activity carried out through your account.

You must not transfer, sell, assign or otherwise provide your account to another person.


Section 2: Our Products

We make reasonable efforts to ensure that product descriptions, images, ingredients, nutritional information and other product information displayed on our website are accurate and up to date.

However, colours and product appearance may vary depending on your device, screen settings and other factors.

Product descriptions, availability, pricing and other information may be updated from time to time. We reserve the right to discontinue products or limit quantities where reasonably necessary.

Nothing in this section limits any rights you may have under the Australian Consumer Law.


Section 3: Orders

When you place an order through our website, you are making an offer to purchase the products selected in your order.

An order is accepted when we confirm the order and have received payment, unless we notify you otherwise.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable;

  • there is an obvious pricing or product description error;

  • we reasonably suspect fraudulent or unauthorised activity; or

  • we are unable to fulfil the order for another legitimate reason.

If we cancel an order after payment has been made, we will provide a refund for the amount paid for the cancelled products.

Please review your order carefully before completing your purchase. Cancellation requests are subject to our Refund, Returns, Exchanges & Shipping Policy.

Your purchases are also subject to any rights and remedies available to you under the Australian Consumer Law.

Our products are intended for personal and household use unless otherwise agreed with us. You must not purchase products for commercial resale without our prior written consent.


Section 4: Prices & Billing

Prices, discounts and promotions are subject to change.

The price charged for a product will generally be the price displayed at the time you place your order and will be confirmed in your order confirmation.

Unless otherwise stated, prices displayed on our Canadian online store are in Canadian dollars (CAD).

Applicable taxes and shipping charges will be displayed at checkout where applicable.

We may offer promotions from time to time. Promotional offers may be subject to additional terms and conditions. If there is a conflict between promotional terms and these Terms, the promotional terms will apply to the extent of the inconsistency.

You agree to provide accurate and complete payment and billing information for all purchases.

You represent that you are authorised to use the payment method provided and agree to pay all amounts properly charged to you.


Section 5: Shipping & Delivery

We aim to process orders within 1–3 business days.

Once an order leaves our warehouse, delivery typically takes 4–14 business days, depending on your location and shipping provider.

Delivery times are estimates only and are not guaranteed. Delays may occur due to shipping providers, weather, public holidays, high shipping volumes or other circumstances outside our reasonable control.

Once an order has been handed to the shipping provider, delivery is managed by that provider. However, nothing in these Terms limits any rights or remedies you may have under the Australian Consumer Law if an order is not delivered or is otherwise affected by a problem with our supply of the products.

Section 6: Intellectual Property

Our Services and their content, including but not limited to our trademarks, logos, brand names, text, images, graphics, product photography, videos, audio, product reviews, designs and the selection and arrangement of these materials, are owned by The Gut, its affiliates or licensors and are protected by applicable intellectual property laws.

You may access and use the Services for personal, non-commercial purposes.

You must not, without our prior written permission:

  • reproduce, copy or republish our content;

  • modify or create derivative works from our content;

  • distribute, sell or commercially exploit our content;

  • use our trademarks or branding;

  • publicly display or reproduce our content for commercial purposes; or

  • use automated systems to scrape or collect content from our website.

Nothing in these Terms grants you ownership of or a licence to our intellectual property except where expressly stated.

The Gut’s name, logos, product names, designs and slogans are trademarks of The Gut or its licensors.

Shopify’s name, logo, products and services are trademarks of Shopify.

All other trademarks appearing on the Services belong to their respective owners.

We may provide access to third-party tools or services as part of our Services.

These tools may be operated by third parties and we do not necessarily monitor or control them.

Your use of third-party tools may be subject to the terms and conditions of the relevant third-party provider.

The Gut is powered by Shopify, which enables us to provide the Services to you.

However, any purchases you make through our online store are transactions directly between you and The Gut Pet Pty Ltd.

Shopify is not responsible for the products we sell, the fulfilment of your orders, or any issues arising from transactions between you and The Gut, except to the extent required by applicable law.

By using the Services, you acknowledge that Shopify and its affiliates are not responsible for the sale, supply or fulfilment of products purchased from The Gut.

Nothing in this section excludes or limits any rights that cannot lawfully be excluded or limited.

Any personal information we collect through the Services is handled in accordance with our Privacy Policy, which is available on our website.

Because our Services are hosted by Shopify, Shopify may collect and process certain information relating to your access to and use of our website.

  • your Feedback does not infringe the rights of another person;

We may remove Feedback where we reasonably consider it to be unlawful, misleading, inappropriate or in breach of these Terms.

You remain responsible for the content of any Feedback you provide.

From time to time, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping charges or delivery estimates.

We reserve the right to correct errors and update information when reasonably necessary.

If an obvious error affects an order you have placed, we may contact you to discuss the issue or, where appropriate, cancel the affected order and provide a refund.

Termination does not affect any rights or obligations that arose before termination.

Any provisions which by their nature are intended to continue after termination will continue to apply, including provisions relating to intellectual property, Feedback, liability, indemnification, governing law and jurisdiction.

To the maximum extent permitted by law, we do not guarantee that the Services will always be uninterrupted, secure, timely or error-free.

Information provided through the Services is intended for general information purposes and should not be relied upon as professional veterinary or medical advice.

Product information provided on our website is intended to assist customers in making informed purchasing decisions. If your dog has a medical condition, allergy, dietary restriction or other health concern, you should seek advice from your veterinarian before introducing new treats or dietary products.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.


Section 16: Limitation of Liability

To the maximum extent permitted by law, The Gut and its directors, officers, employees, affiliates, agents, contractors, service providers and licensors will not be liable for indirect, incidental, special or consequential loss arising from your use of the Services or products purchased through the Services.

This may include loss of profits, loss of revenue, loss of data or other indirect losses, except where such liability cannot lawfully be excluded.

Nothing in these Terms excludes, restricts or modifies:

  • our liability for a matter that cannot legally be excluded or limited;

  • your rights under the Australian Consumer Law;

  • liability arising from fraud or fraudulent misrepresentation; or

  • any other liability that applicable law does not permit us to exclude or limit.

To the extent permitted by law, you agree to indemnify The Gut, its directors, officers, employees, affiliates, agents, contractors, licensors and service providers against reasonable losses, liabilities, claims and expenses arising from:

  1. your material breach of these Terms;

  2. your unlawful use of the Services; or

  3. your infringement of another person's rights.

This indemnity does not apply to the extent that the relevant loss or claim was caused by The Gut's own breach, negligence, unlawful conduct or other matter for which liability cannot lawfully be excluded.

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally possible.

If it cannot be made enforceable, it will be severed from these Terms without affecting the validity of the remaining provisions.

If we do not immediately enforce a right or provision under these Terms, that does not mean we have waived that right.

These Terms, together with our Privacy Policy and other policies expressly incorporated into them, form the agreement between you and The Gut concerning your use of the Services.

These Terms replace any previous terms relating to your use of the Services.

Nothing in these Terms prevents either party from relying on rights or remedies available under applicable law.

You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where permitted by law.

We may transfer or assign our rights and obligations under these Terms as part of a business sale, restructure, merger, acquisition or similar transaction, provided that doing so does not reduce any rights you have under applicable law.

These Terms are governed by the laws of New South Wales, Australia.

You agree that the courts of New South Wales, Australia have non-exclusive jurisdiction in relation to any dispute arising from or relating to these Terms or your use of the Services.

Nothing in this section limits any rights or protections you may have under applicable consumer protection laws.

The headings used in these Terms are for convenience only and do not affect the interpretation of any provision.

Your continued use of the Services after updated Terms are posted constitutes acceptance of the updated Terms to the extent permitted by law.

Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies available to consumers under the Australian Consumer Law, including the consumer guarantees that apply to goods and services.

Where the Australian Consumer Law applies, you may have rights to a repair, replacement, refund, cancellation or compensation depending on the circumstances.

These rights apply in addition to any voluntary returns, exchanges or other policies offered by The Gut.
